By renting from Wolf Pen Gap ATV Rentals, LLC, an Arkansas limited liability company, any all-terrain vehicle for a limited period of time, you agree to the terms and conditions and rules of operation and safety as noted in this agreement.
Wolf Pen Gap ATV Rentals, LLC makes no warranty of any kind, nature or description, express or implied, as to the quality and manufacture, safety, drivability or fitness for any particular purpose of any vehicle or equipment covered by this agreement. Driving ATVs with other like vehicles and riders is an activity carrying risks of serious personal injury, property damage, or death. There are normal, mechanical and environmental conditions and risks which independently or in combination with your activities may cause serious injury or even death to you or others, as well as property damage. Wolf Pen Gap ATV Rentals strongly urges the renter and other riders to have medical insurance prior to engaging this activity. The renter and any additional riders represented personally accept all risks and liabilities of this activity. You must certify that you have adequate insurance to cover any injury or damage you may cause or suffer while participating or else personally agree to bear the costs of such injury or damage. You are additionally responsible for a daily insurance fee in addition to your rental fee. You must further certify that you are willing to assume the risk of any medical or physical condition you may have. You must also agree to give up legal rights and in good faith relieve and release Wolf Pen Gap ATV Rentals of any duty legally owed to you in relation to the contact of this activity.
Additional Terms and Conditions and General Rules of Operation
- Renters must be at least 21 years of age.
- Riders will wear proper safety equipment when operating ATV. All passengers 12 years and under must wear DOT – approved helmets at all times while ATV is in operation. (We have helmets for you to borrow)
- There are to be no minors operating the ATV. Drivers must be 18 years of age.
- You will not consume alcohol, drugs, or ingest any substances that could or would adversely affect your ability to safely operate the ATV.
- You will operate the ATV on the US Forest Service trails and public roads where allowed in Mena, Arkansas and will not trespass on any property where you are not allowed to operate the ATV. You will ride safely and follow posted laws and speed limits. If ATV is rendered inoperable, regardless of who is at fault, on any property other than forest service trails or legal roadways you, the renter, will be charged any and all recovery costs to bring the ATV back to rental facility and will forfeit any deposit to Wolf Pen Gap ATV Rentals.
- You must agree to avoid driving in any areas you do not believe you have the skills to operate the ATV. There is the possibility of rough terrain. Passengers can be jolted, jarred, and otherwise shaken during rides. It is possible that riders could be injured if they come into contact with other riders or equipment. Injuries can be sustained from items on the trail such as holes, bumps, ruts, tree limbs and branches or rocks. The renting party is responsible for all members of his/her riding group.
- The check out time is no earlier than 8 AM and check in time is no later than 5 PM. There are no refunds or discounts if you are late to pick up. No refunds will be issued on cancellations due to any natural event such as rain. If you are late to turn in your ATV, you will be charged in 1/2 day increments for a late fee. If ATV is brought back more than four hours late on check in date a full day’s rental will be charged. Wolf Pen Gap ATV Rentals will take legal action and seek prosecution if ATV is over 24 hours late from the specified check-in date without calling to arrange for additional days rental.
- No refunds will be issued for reservations unless you notify Wolf Pen Gap ATV Rentals at least two weeks in advance of the pick up date, in which case you will be subjected to an $85 per day of rental cancellation fee. Later notice will be subjected to a 60% refund. Refunds will not be issued for reservations made the same day. If you are not satisfied with the performance of the ATV, you do not get a refund. We pride ourselves on having well-maintained ATVs, so unless an unforeseen mechanical failure occurs, you should be pleased with its performance, and therefore no refund will be issued.
- The renter is personally liable for all loss or any damage caused to any ATV, other vehicle or equipment covered by your rental, including and beyond any damage deposit. Wolf Pen Gap ATV Rentals will charge your credit card account for any and all additional rental, damage and loss of use charges that you may incur under the terms of your rental agreement.
- In lieu of large security deposits, Wolf Pen Gap ATV Rentals charges a non-refundable daily insurance fee for each ATV rented.
- You will not submerge the ATV in rivers, holes, or any other body of water beyond the ATV’s design capabilities. If, upon inspection, it is obvious that the ATV has been submerged, you will be charged for any costs of repair.
- No more than three riders are allowed in the three-passenger ATVs. No more than 6 riders are allowed in the six-passenger ATVs.
